LinguaFlex — Privacy Notice

This notice explains how LINGUATALKS LTD, trading as LinguaFlex, uses personal data about students, visitors to our website and contacts at our partner schools.

1. Who we are

1.1 LINGUATALKS LTD is a company registered in England and Wales under company number 16684217, with its registered office at 167 King Street, London, England, W6 9JT ("LinguaFlex", "we", "us"). We are the controller of the personal data described in this notice.

1.2 You can contact us about your personal data at support@linguaflex.co.uk. Partner schools can use schools@linguaflex.co.uk.

2. The data we collect

2.1 Students: name, email address, phone number (if given), account login details, your level test answers and result, CEFR level and other level information you give us, the level assessed by the Partner School, your declaration that you are legally entitled to attend your chosen class, Credit purchases and balances, bookings, cancellations, attendance records, complaints and messages to us, and payment records. Card payments are handled by our payment provider; we do not receive or store your full card number.

2.2 We do not ask for passports or identity documents. A Partner School may ask you directly for documents it needs for its own legal and accreditation obligations, and is responsible for that data.

2.3 Partner school contacts: names, job titles, work email addresses and phone numbers, and the payment and invoicing details of the school.

2.4 Website and app use: technical data such as device, browser, IP address and the pages used. Our Cookie Notice explains the cookies we use.

2.5 Other sources: we receive attendance and class records and placement decisions from Partner Schools, payment information from our payment provider, and partner school contact details from the schools themselves or from their public websites.

2.6 To create an account we need your name, email address and login details. Before your first Credit purchase we need your level test result. To process a purchase we need the payment details. Before a booking we need your eligibility declaration and the booking details. Without the information needed at each stage we cannot provide that service. Other information is optional.

2.7 You must be at least 18 to use LinguaFlex.

3. Why we use your data and our lawful basis

3.1 To create and manage your account, assess your level and show you suitable classes, sell Credits, make and manage bookings, share the necessary details with the Partner School delivering your class, record attendance and provide support: because this is necessary for our contract with you or to take steps you ask for before entering into it.

3.2 To keep accounting, tax and payment records and to meet other legal duties: because we have a legal obligation.

3.3 To prevent fraud and misuse, keep our services secure, handle payment disputes and chargebacks, enforce our terms, defend legal claims, deal with complaints and improve our services: because of our legitimate interests in protecting LinguaFlex, our customers and our systems, and in running our business effectively.

3.4 To contact schools about partnership, manage our relationship with partner schools, administer agreements and pay them: because of our legitimate interest in developing and running our partner school network.

3.5 Marketing: we send marketing emails with your consent or, where the law allows, about our own similar services if you gave us your email address when buying from us and were offered a clear chance to opt out and did not opt out. Our lawful basis is consent or, where this applies, our legitimate interest in promoting our services. You can opt out at any time using the link in each message or by contacting us.

4. Who we share data with

4.1 The Partner School delivering your class receives your name, booking details, CEFR level and confirmation that you have made the eligibility declaration. The school uses this data to deliver the class and meet its own obligations, and is responsible for the data it processes for its own purposes. It may not use this data for marketing.

4.2 Service providers, including our payment provider and our hosting, email and IT providers. Depending on the service, they act on our instructions or as separate controllers.

4.3 Our professional advisers, such as accountants and lawyers.

4.4 Authorities, courts or others where the law requires it, or where needed to establish or defend legal claims.

4.5 A buyer or successor if all or part of our business is sold or transferred.

5. International transfers

Some of our service providers may process data outside the UK. Where they do, we rely on UK adequacy regulations or on safeguards required by UK law, such as the UK International Data Transfer Agreement or Addendum. You can request further information and a copy of the applicable safeguards by emailing support@linguaflex.co.uk.

6. How long we keep data

6.1 Account data: while your account is active. If there has been no login, purchase or booking for 2 years and you have no valid Credits, we close the account and delete the account data, except information kept for the other purposes and periods set out in this section.

6.2 Purchase, payment, booking and attendance records: 6 years from the end of the financial year to which they relate, for accounting, tax and legal-claim purposes.

6.3 Support messages and complaints: 2 years after they are closed, unless needed longer for a dispute.

6.4 Marketing data: while you remain subscribed. If you opt out, we keep only the minimum needed to make sure we do not contact you again.

6.5 Partner school contact data: while we have a relationship with the school. Contract and financial records: 6 years after the agreement ends.

6.6 Security and technical logs: up to 12 months, unless needed longer to investigate an incident.

7. Your rights

7.1 You have the right to ask for access to your data and to ask us to correct, delete or restrict it, to object to our use of it, and to receive it in a portable format. These rights depend on the circumstances. Where we rely on your consent, you can withdraw it at any time.

7.2 You have the right to object at any time to the use of your data for direct marketing.

7.3 To use your rights, contact support@linguaflex.co.uk. We normally reply within one month; where the law allows, we may extend this and will tell you why.

7.4 To make a data protection complaint, email support@linguaflex.co.uk. We will acknowledge it and tell you the outcome. You can also complain to the Information Commissioner's Office (ico.org.uk).

8. Changes

We may update this notice. The current version is always available on our website and in the app. We will tell you about changes where the law requires it.
